Re: Shot in the Dark - Arkansas Times on Tracy Ingle

There are so many mistakes in how the authorities handled this situation I have no idea where to begin.

Quote:
In the warrant obtained to search the house at 400 E. 21st St., a copy of which was obtained by the Arkansas Times, police say they believe the house in question contained “crack *******.” That description has been carefully scribbled out, with “methamphetamine” written in above and initialed by Judge Randy Morley.
And furthurmore...

Quote:
According to an affidavit signed by NLRPD narcotics investigator Mickey Schuetzle, narcotics had been sold from the residence. In that document, Schuetzle doesn't elaborate on who sold him the narcotics, what was sold, or when.
This alone renders the warrant null and void and thus makes the ensuing action taken as illegal and a violation of the citizens Fourth Amendment rights.

“ The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."

It is painfully obvious that the authorites had no idea exactly what illegal "articles", if any, they were searching for and as such no warrant should have ever been issued.

The para-military like actions on the part of police forces nationwide is turning our country into a state of marshal law. I'd like to see an end to throwing flash-bangs into the apartments of elderly women causing them to die. No knock search warrants puts officers, suspects, partners/children of said suspects, and anyone else nearby directly in harms way, creating a situation where there is not a probability someone will get killed...it assures that someone will.
