The nonprofit status is part of the issue. There is no such thing as a not for profit business in this country. Everyone makes money. You could open a dispensary and show a business profit of zero but pay yourself $1,000,000 a year. So it kind of becomes whether a prosecuting attorney wants to nail someone for being a for profit business.
