Need help with CA law vs County

All of us in California are fucked. You just realized that?

The pablum puking liberals in Sacramento, San Francisco and Los Angeles know what's best for us. We are too stupid. The voters made it clear what the definition of marriage should be - doesn't matter. The voters made it clear that we want access to meds - doesn't matter.

Us growers are treated the same as we were in the 80's. No difference. It is NOT legal in California - and the rules are not applied equally. Do what you have to do, but realize that you are taking the risk of years in prison. It still happens.

Liberals? ..It is the conservatives who are trying to block cannabis growth and medicine. I believe in liberty and I believe in Guns, Liquor, Cannabis, and sex. Holy crap, I`m certainly NOT a conservative. lol.. :peace:

..To answer your question, PT420, they can ban the sale of cannabis but you can combat your rights to grow in court and probably win. Please check this website: Ca Supreme Court Strikes Down Medical Marijuana Possession, Cultivation Limits | California NORML

I figured screw them anyhow..

Im not just talking about MJ. There is more to California than MJ. This state is SO fucked up it is amazing. FUBAR.

I live in Shasta County; arguably in the "emerald triangle". Our largest exported crop is MJ - but the cops are completely ignoring state law and doing as they damn well please. Unreasonable stops, warrantless searches and confiscations of medicine despite recommendations are common. When they raid they take everything. Your computer, cell phone, guns and ammo, cash, jewelry, cars, they empty your bank accounts. Then you go to jail and get asked if you want a lawyer. How the hell you going to pay next months rent - least of all an attorney?

Believe me - it is NOT legal in California.

One way to combat the illegal police tactics we all encounter from time to time: CAMERAS CAMERAS CAMERAS, especially in the vehicle. It keeps them honest, I predict that within a few years tops all vehicles will either have them standard or will b outfitted w them. Laugh if u want, it could very well save u from being murdered on ur next stop. People really have no idea how their very lives r in peril each and every time they r stopped by the police...

I agree, BUT ... you have to remember that the pigs will steal everything, as in EVERYTHING, that has value or can counter their lies. If you don't think that they will 'confiscate' or 'disable' electronic equipment and then take it with them "to the crime lab for evaluation" (where, I guarantee you, it will be 'lost' or corrupted beyond recognition) you are sadly mistaken. That is why I never carry my smart phone when I am delivering - they'd steal it and 'investigate' and hassle every one of the contacts in my phone.

If the camera uploaded constantly to a cloud account that was sufficiently secure to allow you to move it off of the secure account to a hidden and secure account right after you were detained, beaten and shot -- maybe.

It is very difficult, as in nearly impossible to fully protect ourselves from "the King's men." We gave up all of our God given rights immediately after 911 - and they won't be back until after The Revolution.

Power to the people.
Long Live the King.

I was in a collective that got raided last year - some day I'll sit down and tell the whole story. I wonder though - how many would believe the corruption and bullying that I saw go on. The lies, the fear tactics. The way sick people were treated like terrorists; guns, all black swat suits. The physical damage they did, the emotional damage they did.
And the lies in court. Lies. Perjury. One detective was caught committing perjury - yes, CAUGHT. On the stand, caught telling lie after lie in a felony case. Know what happened to him? Nothing. Judge let him go. This is ON RECORD folks - can be proven.
What do you think would happen to you or I if we lied on the stand in a felony case? We'd of left that courtroom in handcuffs ... for starters, then things would have gotten bad.
We live in Amerika now. Too bad too.

Agreed, pretty much 100%. I actually assumed such a recording design, wirelessly uploaded, no storage onboard to b tampered with. It's very doable w today's off the shelf tech...
I too am a bit cynical, lets just leave it at that but, u don't think such systems r a deterrent for the less than professional officers out there? The borderline hundreds of videos I've now seen seem to indicate otherwise, just saying...And at least its something, a tool at the disposal of any law abiding citizen, and any such tool is something id b interested in and I'm sure I'm not alone...

Seen a few of those dispensary raids too, they were awful but again thanks to the use of cameras I and millions of others got to see and learn from the experiences...
Its the potential exposure of those lies pumped directly to the public for scrutiny and analysis that is and will always b the deterrent. Its the uncertainty that not only the person or vehicle may b recording, but also the bystander whipping out his/her camera nearby.

It has pretty much been proven, AG research in several states, that departments that require camera's on their cops have a significant reduction in the number of citizen complaints AND a significant decrease in the number of arrests for resisting arrest. It seems that the camera results in better behavior of BOTH the cop and the citizen. I see little downside to them. And, if I was a cop - hell, I'd invest in one for myself. They are good protection for both sides.

I am 61 years old. When I was a lad a half century ago I was taught that if a citizen was in trouble, they should find a cop and that it was their job to help. And back then, for the most part, it was true. It is so sad to me, that in one lifetime it went form that - to the fact that a cop is the LAST person you want involved. The odds are that the cop will create more problems than he will 'solve'. His job is to make arrests, issue citations, write reports and get on to the next donut.

I simple avoid all predators. Police, pimps, thieves, judges, bail bondsmen, con artists, gang bangers ... all predators. I avoid them.

PS: In regards to cameras in the collective. The first person through the door in my case was a plain clothes detective with a warrant in one hand and a 9mm Glock in the other. He walked to the back of the waiting room and yelled that everyone was to put their hands up and remain seated. Two uniformed cops ran in with wire cutters in their hands and started cutting wires to the cameras. It was the second thing they did. And the tape later was lost in the evidence room. No actions were taken till the cameras were disabled.

Lol me n u have much in common bro, from our what would surely b labeled as a "cynical" outlook by many to our approaches to life and its various pitfalls...
One correction though, cops didn't sign up for nor do most regard very highly the part about writing reports, the accountability aspect of their jobs r a genuine bummer to most :p

Its is however, SPOT ON ur description of the obvious shift in mentality from one of "protect and serve" to a far more malicious "coerce and collect"...Yep, it's scary as hell and to boot, the true Patriots of this country r long dead and buried so don't expect any favorable change in this lifetime until they emerge again, if ever...

Indeed, the age of acquiescence is upon us and will b our undoing unless we evolve and stand together...

I do know one thing: our forefathers would've fuckin raged endlessly against a fraction of today's assorted bs. Wtf happened to us??

Also, just curious about what happened when (I assume) yourself and the scores of other eyewitnesses testified in court to the fact that the dispensary cam footage was obviously tampered with and/or destroyed? The judge had no issue w this? Seems to me on these grounds alone any awake and breathing lawyer could've had this dismissed seconds after this small tidbit was revealed?
Sorry to bring back such obviously shitty memories, just trying to understand what happened...

The graft and theft in government starts at the very top. The very, very top. Like, the White House. And it is not reserved to any particular political party. The Democrats are just as dirty as the Republicans. It started a long time ago, and the necrosis has spread downward to the very bottom of the food chain. From President, to Senate, to Congress, to Supreme Court, to Governors, to States Atty Generals, to District Attorneys, to Judges, and right down to the foot soldiers - cops.

There was a picture taken of the inside of the "lab" where concentrates were supposedly being manufactured. The photo introduced into evidence showed a workbench that was obviously being used as a cloning station (not illegal in California), with a crockpot and a half gallon of alcohol sitting nearby. The cops testimony was that they found it "just that way upon entering the lab". The lawyer went to the evidence lab and found another picture (that they should have destroyed but didn't) that showed the same bench WITHOUT the crock pot and alcohol. There were other pictures with the crockpot in the home, on the kitchen counter - same crockpot right down to a small dent on the outside. Question was: how could the crockpot be in two places at the same time? Answer: cop moved it to the 'lab' so it would take a better picture. Also, the alcohol was in a different building all together and was used to clean scissors and such. They not only created evidence - they lied about it on the stand. And, that was proven.

The judge found that there were other 'reasonable explanations' for the 'discrepancy' of testimony between witnesses and police. In his decision he failed to mention all together the photographic evidence that there was tampering of physical evidence. The defendants attorney (who is a REAL BADASS) took the ruling with a grain of salt as it was an appeal point if the verdict went against the defendant (which it didn't - they were found not guilty of all charges). Remember - the judge is one of The Kings Men. He's got a great job that pays over $200k a year, he is willing to blow The King for that kind of money.

Sometimes I am glad I am 61 years old. I am sad by what I see happening today. I don't want to see what it will be like in 20 or 40 years. Am I cynical? Maybe. I think I am a realist.

I am a student of history. I love reading about history, especially from the other points of view. Humans make the same fucking mistakes, over and over and over. Countries and societies have gone down the same road we are going down - maybe it's normal. Maybe its just the normal aging process - like arthritis in old people. It just happens.

The Untied States of America has had a great run. A fantastic run. We did a lot of good shit for and on the planet. Earth is better off because we are here. But, I fear that those days are now behind us. Lots of parallels to the Roman Empire. They became evil - a killing machine. Jesus tried to point that out - and got tortured to death for it. We are there now, and I think our end will be similar. I hope I am wrong, I really do.

Cynics r often confused w realists, in my experience. I'm called cynical all the time, especially by those who don't really know me all that well. Luckily for me, I couldn't possibly care less (lol)
Good analogy, The Kings Men, sounds like another bestselling Orwellian type of novel in the works here :)
Again i have to say how much we seem to have in common in our views, I should look u up when i arrive in ur neck o the woods in a couple months. Personally, i like dealing in facts, maybe the engineer in me, maybe the "no time or energy for bs" in me, whatever. U seem much the same and i appreciate that in ppl...
Yep it's definitely a pretty scary scene out there for sure but we can't give up, we have to learn how to fight on the same level, we have to learn how to level the playing field, and we all have to become more active in this fight, it's just too damn important to acquiesce. Whether a grower or an avg citizen still concerned about our rights and the founding principles of this country, it's just far too important to give up!
Relating to cannabis, i do believe that the days of this plant on federal schedule 1 r coming to an end and we will definitely see it in our lifetimes (yes, yours too :). Obviously the sooner the better! We r learning, albeit rather slowly but at least we're learning and making progress, hell we even have lobbyists now (a more than integral part of "The Kings Men", hell lobbyists practically r the equivalent of kings in this country!). If we keep making progress the momentum will continue to drive us forward towards our goals :)
Never give up, challenge authority, it's what Americans (used to) do...
"People shouldn't fear government, government should fear it's people" - dunno who said it but its gold man, gold :)

Absolutely give me a holla when you hit our area. I'd like to introduce you to "my girls", and I'm sure they'd like to meet you too.

This country is lining up to make a choice, and they're not good, either one. The first possibility is socialism of the Joseph Stalin type. Democrats will fill that order. The second is fascism, of the Adolph Hitler type. Republicans are ready there. I think we'll end up on the fascist track. All we need is one more major attack by Islam; one that makes 911 look like a party. I think it is coming. The world is letting the extremists get nukes, on purpose ... and it will happen, then everyone will get on the 'revenge wagon' and it will be off to the races. People of color will be rounded up (enemy), at the same time the educated that don't work for the gov't; teachers especially. That's how the Nazi's did it in the 30's - and it'll happen again. Hell of a choice eh? Joe Stalin, or Adolph Hitler. Who'd you rather live under?

And ... when it does happen ... it will be people like you and I that get leaned up against a wall and shot FIRST. The ones that have been taught how and know how to ask questions ... and do the research to find out how, why, who, when, where, etc. I can only hope that my executioner does it humanely.

It has already been decided. It will happen.

Till then ... I need to go look for my favorite bong. I swear I left it beside my easy chair ... have you seen it?

~ Auggie ~

Sounds like farenheit 451, 1984, and a smidge of slaughterhouse 5 in there as well bro. Lol nope, cant say i like either of the 2 choices u offered...BUT, as long as i DO still have a choice, yes pls, pass me that there bong, it's right where u left it bro :)

Maybe it's not all that bad to b among the first to b shot?? Hell if we go out properly maybe we'll get a building or something named after us :p

Once again i gotta agree tho (unfortunately...this shit is pretty fuckin bleak!). 911 seems to have been the catalyst, the beginning of the end, when we began to willingly and happily trade our rights for a really really false sense of security. Pfffft, homeland security, what a horrible joke!

If it was indeed terrorists, then they already won. Everything they set out to achieve has been achieved, all we need do is pay attention to see that truth...
At this point only revolution will save us...and some really MASSIVE shifts in policy both foreign and domestic.

<lol end rant>

(Someone shot the soapbox i was standing on...terrorists aaaahhhhhhh!!)

Have you read either of Ayn Rand's books? Google her, and read her bio. Wikipedia has a great write up on her -- after you've read her brief bio, read "Atlas Shrugged", if you haven't already. An amazing 'story' that predicted where we are in right now fifty years later, and where we will be twenty years from now. She saw what was coming - because she lived in a country that had already done what we are doing. But, as she put it once, "Americans do EVERYTHING better - even bad stuff." Atlas was made into a movie, and sequel. But, as usual, the book is better. The movie is ok; but the book is great. I gotta read it again, its been a few years.

My favorite quote from the book, gives me goose bumps every time I read it:
"When you see that trading is done, not by consent, but by compulsion- When you see that in order to produce, you need to obtain permission from government men who produce nothing- when you see that money is flowing to those who deal, not in goods, but in favors- when you see that men get richer by graft and by pull than by work, and your laws don’t protect you against them, but protect them against you- when you see corruption being rewarded and honesty becoming a self-sacrifice- you may know that your society is doomed."

Look at what's happened on Wall Street this last decade. Look what's happened in politics the last decade. Look what's happened with organized religion ... all of the "institutions" that civilized men rely on, and tell me we're not there. We're there.

******

I found my bong - and while looking for it found a couple of grams of 21% Gooey Hash flower that I grew last year. I had great dreams last nite. I was 16 again; chasing hippy girls in the Ashbury District of San Francisco. It was the summer of love, 1969 ... times were so much simpler then. I had a roof over my head, belly full, a warm body next to me -- didn't need anything else. "Can we go see the Grateful Dead concert in the park tonight?" I assured her we would, and that there was a new singer I wanted to hear, "I think he calls himself Santana, or something like that."

Sup Auggie, I'm not happy that I didn't receive a notification of ur reply here... Or maybe I did and was just too baked to remember...nah, that doesn't happen lol...

Anyhow, great to hear from u again! Always enjoy reading ur insights and its pretty easy for me to relate mostly :)

Your last paragraph fills me w envy, what a great time to b an adolescent! And that Santana guy, priceless :p. Ya I think he became quite a famous artist or something lmao (lmao cuz I'm a guitarist of over 30 years now). Just please, don't tell me you've seen Frank Zappa live or my head may well explode lol!

I've heard of Ayn Rand of course and also the title u mentioned but admittedly I've never read it. Its actually 1 of those books I feel I should've read by now, there's a lot, more than I care to admit. I enjoy reading and used to b a much more prolific reader than I am these days and I do intend to change that, as well as a few other things in my life that need tweaking. Thanks for putting that back in my mind, I'm gonna get me a copy for sure!

My eye is still firmly fixed upon the Sacramento area, I'm a little behind schedule but I'm coming!

Peace out bro :)

Look cut the complaining folks. It ain't the end of the world. Like all laws, these amendments will go through more changes and if more of us would vote and participate in the political process then things would reform and change for the better, but as long as we adults allow Conservatives to push us around in Sacramento, we are what you have been saying-f---ed.
I am an old fart. I was tokin' when it was a felony here in Cali. That was ugly. Reforms in THC laws are being made in many states and the prevailing attitude still holds- Pot's harmless. I feel we cannot afford as citizens of this state and this country to blindly sit on our laurels, get stoned, and not do anything to continue to educate the dumbfound public as well as educating the existing pool of compliant legislating fools whom we supposedly voted into office. Chill folks!!
