The medical marijuana industry is asking the Montana Supreme Court to modify its recent ruling against the growers.

The court ruled earlier this month that a ban on medical marijuana sales does not violate the constitutional rights of registered users or providers. The ruling overturned a lower court decision to block part of lawmakers' restrictive rewrite of state regulations, and sent the case back to District Court with new instructions.

The Montana Cannabis Association argues in a filing this week that a higher standard of review should be applied to the new state law. The Montana attorney general's office has not yet replied to argument.

The Supreme Court's decision in the case is on hold until justices make a decision and formally remand the case to the lower court.
