The Arizona Supreme Court decides Friday on the scope of immunity provided doctors under Arizona's medical marijuana law.
The justices' decision will follow a 2014 ruling in which the Court of Appeals upheld a trial judge's dismissal of forgery and fraud charges against Phoenix naturopath Dr. Robert Gear.
He was charged in Navajo County after signing a medical marijuana certification for a police informant in 2012 based on his examination but before receiving a year's worth of the patient's records.
The form completed by Gear certified that he reviewed the records.
But the appeals court said Arizona's voter-approved medical marijuana law gives doctors immunity for referral decisions regardless of what the form says.
