As one who works with student financial aid I would like to state that the phrasing of the question on the FAFSA states specifically whether or not you have been convicted of possesion or sale.... not trafficking or sale. I would also urge those who have been convicted to complete a rehab program in that the completion of the program shows that you can pass 2 unannounced tests but does not effectively prove that after those 2 you are not currently using. As for the moral and ethical implications in the law I have nothing to say other than its utility is defeated by the educated user.
