As some of you may recall, an army buddy of mine who has honorably served this country for 15 years (and has smoked grass since Viet Nam), who I served with in the Guard, was recently busted on a random piss test. THe Officer who usualy alerted us to the test has been shipped over seas, so there was no warning this time :(
WHen he talked to the commander, he asked if anything would change if he could provide a doctors note stating he uses marijuana for medical purposes. Seeing as this is the CALIFORINA National Guard, the COmmander said the note would suffice. SO TODAY, My good buddy GOT THAT NOTE! He went to a doctor close to our location, and got his recomendationb. I will keep eeveryone posted on how the Army responds. -PM |

We're dealing with the Feds in this situation, I wish your buddy the best of luck. I went through the same thing when in car biz. They always make you pee test. Being this is California I was upfront, showed them my scrip.. making me "Handicapped", had to hire me.. but couldn't drive their cars.. BFD. Yeah, they really tripped on that one.. "You'll have to take a pee test." "I'll fail." "Can't hire you." "I am disabled and use medicinal Marijuana as per my MD." "Have to talk to our lawyers." They hired me. Ya gotta love it!

Pinch, that rocks dude. As for state and federal...yes, it's a sticky situation. Because my buddy serves in the CALIFORNIA national guard, yet the NT'L GUARD is also a federal entity, it may just be at the descretion of the commander as to what he will accept as an excuse for a dirty piss test. It seems, in this case, that as long as my buddy can provide a doctos recomendation, than the commander will accept that. However, I'm not certain if thas Army approved. Ill let everyone know as this issue progresses.
As for hiring you, you got pretty lucky there man! Usualy, an employer only has certain legal obligations AFTER they hire someone. FOr example, if I were going for an interview, despite the fact that I'm disabled and registered with the state, if they found out I smoke pot and dont like that, I am not legaly protected. I am only protected if I believe my reason for not being hired was because of my disability. Once I AM hired, however, then I have certain legal protections. SOme employers., surprisingly, are very supportive and non descriminatory when it comes to med pot, and might hire you on the spot if you mention it. But sadly, as of right now, its probably best, if possible, to keep your medpot usage from a possible employer until firmly situated and hired, in my humble opinion. -PM |

By the way, they hired me and I didn't accept the position.. decided to retire and did and do enjoy! You might be right about your buddy in the NG, could be at his superior's discretion. Anywhere they have state sanctioned medicinal Marijuana the descrimination laws cover the MM patient.. yes but as you say best not to "showboat" but rather just get along..
