I'm not entirely clear on the laws for patients of medical marijuana. I'mma list what I think I know and what questions I have... If anyone could confirm, correct or answer it'd be great. =)
1) I can drive around with up to ounces on me legally, I suppose that means running around whereever too, right? 2) I can smoke freely where ever so long as it's not in my car or 1k feet of any school? Whereever people can smoke cigarettes I'm good to blaze? Someone told me this at the marijuana expo the other day and unsure so... 3) I'm free to register with however many dispensaries as I want? Can I visit one dispensary then go to another one same day? As far as I know the above is true and once someone can confirm that my main question is: Are the laws any different for those under 21? Getting caught with marijuana when under 21 gets you a license suspension for a year... So are under 21 patients of marijuana exempt? |

1 In california you can have 4 oz at anytime.
2 Technically yes because of the way the law is written but really when it comes down to it, no. It's safer not to smoke in public. The only people I would tell to do that is the one who can talk your arse off. Let me say I do smoke in public but I'm not only a patient I have a PO for officers to call and ask if I'm a patient so I dont have as much worries as some. 3 yes you can go to as many co-ops as you like. You could sign up at 100 co-ops in a day and be ok 4 yes the above is true but somethings I wouldnt push like smoking wherever you want ect. prop 215 and sb420 protect any legal patient in california regardless of age 18 or 65 its the same law 5 Of course they are because you are a legal patient they cant give you a ticket in the first place and if they do you will have it dissmissed in court as long as your following the rules of prop 215 and sb 420. You only get you licence suspended if you are found guilty in a court of law. I have been pulled over plenty in fact if you search the busted forums you''ll see some of my post about it. Oh also understand that when you have more then a oz on you there is the chance that the cops wont honor your card and take you in anyway. If this happens dont stress out. First make sure you tell the officers that you are a legal patient and that is your medicine and you're going to want it back in 48 hours when you see the judge. Important for them to know that your gonna want that herb back. This way they wont destroy it or anything. Go to jail and within 48 hours you will be released. When you see the judge make sure you have you're origanl note and that should be that. They should then go down to evidence and bring you're herb back up to you and then you would be free to leave.
For me things are easier sorta. I am on probation for felony intent to sell marijuana. I was cleared by the state and my probation office to smoke herb on probation.(I need to make a calareifcation here as I seem to be catching flak for this. Intent to sell does not mean I was selling marijuana it means that I was caught with more then one once of marijuana.) So when ever i get a cowboy cop I make sure to let them know that I am a patient and not only that in my file it says I'm a medical patient so if they want to give me a ticket or take my herb they can expect to be sued for harrassment. My probation officer told me to say that actually. The more you know your right's the less a officer will be likely to fuck with you. Read the laws and check out NORML and ASA websites. Thank you so much for the info... Really helped clarify things.
And yeah... Smoking in public seems risky as the law hasn't been too well established and not all of our law enforcement is familier nor judges. I don't have the resources to get tied in a legal battle, lol. Would you know anything about getting a card, card? I read the sticky on the forum about it but not really understanding... I got my paper prescription so to get the card I just have to contact my county health department or the man who signed my prescription? |

I think he's already got his script from the doctor, I think he's talking about the county sponsored card programs, well depending on where your at, it vaires from county to county. It matters little really, I don't have any government issued MMJ card myself, I just take my doctors original reccomendation with me whenever I'm going to a new club or transporting meds.

I'm in Los Angeles county... I wouldn't really care to get a card but the simple fact that so many of our law enforcers are inexperianced with patients of medical marijuuana I feel the card would give me the little bit of extra protection from the law that I need... It comes with a 24 hour line they can call to verify too, right?
Also, I hate carrying the prescription. Paper gets old easily so... I made a copy of it that I carry with me everywhere but I'm sure the legitimacy of that is even less than the original copy if legit at all... Can I register at a new dispensary carrying only the copy? =/ So yeah, I wanna get an I'd. It'll also be a wonderful conversation starter whenever I open my wallet. |

As of now, I don't think LA has a county adopted card program. California State, however does have an official card program, which you can find applications for here:
http://dhs.ca.gov/mmp/forms/ If I remember correctly, this is the only form of ID that will be accepted by the California Highway Patrol. Hope this helps. peace Marek |

And yea, these cards can be confirmed online anytime by law enforcement. But, then again were talking about LE here, they have to wanna go that far.

In my case I have to carry the original only cause the rec says on it not valid without embossing (the doctor put a seal on it).

My note actually says that too, but I tend to only take the orig on a first visit, then after that most co-ops will accept a copy and your ID. My doc is kinda fastidious, he embossed and sealed all over my letter, and on top of my caregivers name. Anyway, I carry that copy with me everywhere, but keep my original at home safe unless it's a first contact.

I tried that with my last rec (taking it out my purse for safekeeping then promptly losing it) and had to call the doctor for an embossed copy. So now my rec stays in my purse in an envelope.

Hmmm do we 3 all have the same doctor I think we might. Yea I always leave mine at home enless going to a new co-op. Always have a copy on you at all times. I have had plenty of officers tell me mine was fake and I was lying but in the end the always let me go.

My Doctor is in Lake Forest, I know that purple monkey has my Dr.. Dr. Philip Denney. Good man he is.
