Arizona: Residents Fight Medical Marijuana Grow Operation

People in north Phoenix are saying "not in my backyard" to a big medical marijuana-growing operation recently approved by the City of Phoenix.

The grow operation is planned to be a 20-acre facility near East Deer Valley Road and North Cave Creek Road.
The state's medical marijuana laws require grow operations like this one to be at least 1,000 feet from nearby homes. But in this case, the nearest residential area is just over 400 feet away.

"These types of facilities do emit odor. They do have adverse effects such as adverse property values," said Mike McCrery, whose carpentry business shares nearly 300 feet of property line with the proposed marijuana facility. "They need to go into a more rural area."

At a hearing in late December, the City of Phoenix granted an exception to the 1,000-foot rule.
Although there are requirements to notify neighbors about such hearings, McCrery said he and many others had no idea about the hearing.

"I think honestly, the greater group of people feel a little betrayed, like they don't understand how something of this magnitude could happen without giving the citizens an opportunity to voice their opinion," said McCrery.
3TV wasn't able to get in touch with the owners or lawyers of the medical marijuana facility in time for this story. However, the City of Phoenix planning department said the marijuana facility did file all the necessary paperwork and send out required notifications about the hearing on time.

There is an appeal scheduled for noon on February 5th in the Phoenix City Council Chambers.
