10 years for 14 grams on a first offense

My name is Andrew and I am from Oklahoma and i have some other posts in this forum and I just wanted to share my story..


Back last fall i was in class, texting a friend trying to get me a dime to smoke on once i was out because i was having a bad day and the girl who i was texting is fairly attractive after all so I figured it'd be enjoyable to smoke a j with a good looking lady =) but then someone knocks on the classroom door and asks to speak with Andrew *******. I look over and its a cop so i figure well maybe i parked wrong, but no. He immediately cuffs me and announces to my Economics class that I am under arrest by warrant for Distribution within 1000 feet of a school to the amount of 14 grams (understated but thats a good thing i guess). Long story short they tried to get me to talk, I had to force my phone call by grabbing the phone as the detective was escorting me to my cell and call to get bailed out by my parents (thank god they had the money or I would still be in jail now (6 months later))

Right now my only options are either 4-6 years of drug court and let me explain what that entails...


1. Random drug testing up to 2 times a week.
2. Random raids with drug dogs on ALL property (even those abandoned cars people like me keep on their land or the barn my grandparents use for storage)
3. I have to attend 150 meetings of Narcotics Anonymous (NA)
4. I have to pay fines
5. Attend group counseling and rehab.
If i fail any of these i get
10 YEARS IN STATE PRISON


my other option is

10 YEARS IN JAIL



This all is a first offense, whatever happened to the justice system? Hell they did not even do the bust properly, supposedly they had an audio wire tap which is not even admissible in court, and they did a buy on me. to bad that i never sold for myself and only helped my friends get it from people i knew, and arent they supposed to record the serial number on the bill of money and then catch the dealer with that money? Because i wasnt arrested till 6 months after the "offense" and they didnt even get a warrant for it till 3 months after. The event happened in last Feb. and they got a warrant in July and picked me up in October.


Is the system really this blind and broken?

I think you misunderstood things or something. HIRE A LAWYER! EXPLAIN TO THEM YOUR SITUATION!
If your lawyers telling you to plead guilty say NO i'm not guilty. I want to plead not guilty, say they have the wrong guy. I think this is a little deeper than marijuana though lets be honest here.

well first of all, yes i have a lawyer, and im not asking anything. im just putting my experience with being arrested on here. And i am pleading not guilty, but what im saying is oklahoma is NOT the place to try to fight back over this. im lucky this is the new offer, at first it was 20 years in prison or 10 years of drug court. this is a vast improvement, and the reason my lawyer said they wont come down even as a first offense is because the newspaper reports on it and they dont wanna seem like their not hard on drugs on school grounds

They have pictures of text messages that i did not send because at the time i supposedly sent them i was in a fraternity meeting, but i cant prove that because i dropped out of it and none of them will say anything for me.

on my case report only clue i have is they accidentally refer to the CI as a she.

i do not understand did you have 14grams on you.. or was it in your car.. mabye im just a retard but im kinda lost can you tell me where the 14 grams came from ...

i do have a friend who is in the DA office i could ask him for some advice he got me out of some litle stuff when i lived in ok

all they had was pictures of text messages talking about someone to come pick up a half

and it wasnt even me that was selling it i just introduced ppl to where they could get it.

I probably start drug court in 30 days cuz thats when my court is, so im clean atm.

God damn, if they are handing out dimes for half ounces I would have got a million years in Oklahoma I can't wait for herb to be legal so I can smack someone in the face with a cola with no fear of a felony

i think what the problem abikai would run into is he was with in 2000 feet of a school and oklahoma has Mandatory minimum sentence and its doubled becouse he was with in 2000 ft

im with you tony i wish they would just make it legal and i would be happy to pay my taxes on it

Yea dude, its 1000 feet but i follow you,


Thats why i cant get off with a deferred sentence, only reason they wont give it to me anyway is they dont want people in ada thinking that someone can get away with selling weed at a school and only get a deferred sentence, hell in th paper last week they were gloating that no one that sells within 1000 feet get a reduced sentence at all and most go to drug court and the rest go to the state pen.

i was just using the norml state law's page that said 2000 feet but i know in trexas its 1000 ft also

I think the lesson that one can take from this is that they really, really don't like dealing near schools. (In all states, not just OK.)
Don't do it.
When acquiring the herb make sure that all the steps of the process (including asking "Dude, are you heavy?") are done away from a school. That means that you (away from a school) should not call a friend who is near a school when the call is taken.

first off as far as ik a dime = a 10 bag hence the word dime. and u aint gettin no 14 grams as a dime.
2nd they did not come in and arrest u because a text message said u wanted to buy a dime after class. they had to have alot more evidence then afew text messages

ok so first of all i said that i was busted for selling a half, the dime is a different story and i explain that below,

and no, all they had was those pictures of text messages, you don't have to believe me. hell if you want, i can scan and copy the case report onto here, but id really rather not have to go in and censor my name and what not. the dime after class was only what i happened to be talking about when i got picked up, they already had the warrant for distribution so thats just an added goodie they found.

they supposedly had a CI text me back in april ( i was picked up in august as i stated) that i was apparantly close friends with text me and ask me for the half, i had them come by but i didnt hand them anything cuz they knew who i was going to so he came in (which further shows we trusted whoever it was its been to long now to distinguish the day) and handled it.

i was listed as an accomplice on the warrant but I am still receiving full sentencing. I don't really appreciate being called a liar and second, why would anyone ever joke or lie about this kind of thing anyway? i wouldn't have posted it here just for kicks and giggles i posted it here because im getting screwed by cops who are railroading LOTS of people into jail and/or drug court down here and wanted to hear what anyones opinion was on this.
