CA: County Supervisors To Consider Marijuana Ordinance

The Tulare County Board of Supervisors again will take up the issue of commercial nonmedical marijuana activity in the unincorporated areas when they meet Tuesday.

Supervisors will consider extending an interim ordinance that bans all commercial, nonmedical marijuana use and activities.

Adopted last month, the current ordinance, applicable in the unincorporated county areas, bans:

-Commercial nonmedical marijuana activity.

-Any outdoor nonmedical marijuana cultivation on private residences in the county,

-Indoor cultivation in unincorporated areas, expect for indoor cultivation that complies with certain reasonable regulations set by the county.

Commercial and medical use of marijuana became an issue when Prop. 64, known as the Adult Use of Marijuana Act, passed in November. Under state law, adults can legally use marijuana for nonmedical purposes.

In addition, the new state law establishes a licensing process for the sales of marijuana for recreational uses and calls for taxing the sale and cultivation of the plant.

However, the state law also allows for local governments to ban commercial sales and limit where businesses can be located. With the ordinance, supervisors did just that.

Under federal law, marijuana use is illegal and subject to prosecution in federal court. The new law doesn't change possession, use, cultivation and distribution of marijuana for medical purposes.

Prop. 64 allows non-medical recreational used indoors. Also under Prop. 64, marijuana plants are limited to six per household and can't be grown outside.

On Tuesday, at the request of county administrators, supervisors are expected to extend the ordinance.

Previously, county administrators and law enforcement addressed the board and reported on illegal marijuana activities in county's unincorporated areas, including robbery and homicide.

At that time, marijuana use supporters and others called on the supervisors to relax the local ordinance and allow for other businesses to open. CannaCanHelp Inc., located in Goshen, also requested for a permit to expand. The supporter for a relaxed ordinance pointed to the increase in tax revenue stemming from marijuana sales.

An item on marijuana use was on the board agenda last week but was withdrawn.

The discussion Tuesday will include public comment.
