SAN JOSE, Calif. - Medical marijuana dispensaries have found their way to San Jose in a major fashion. One local paper has nine pages of ads where medical marijuana can be purchased in the city. There are 110 pot clubs with more in the planning stages.

At San Jose City Hall on Wednesday night, officials held a hearing on proposals to limit the number of pot clubs.

San Jose Vice Mayor Madison Nguyen said it was something that demanded the city's attention.

"The proliferation of medical marijuana establishments is something that we can't ignore," said Nguyen.

The city said all of the clubs are in violation of zoning laws and some are selling marijuana to people who are not legitimately sick

"We have never contemplated the idea of having marijuana being sold sort of like a Stop-and-Go kinda situation where people can get a card and purchase marijuana," said Councilwoman Rose Herrera.

Now there's a call to limit dispensaries in San Jose to just ten.

Councilman Sam Liccardo said an auction was one way to approach limits.

"Certainly we could consider a franchise agreement like with garbage or with tow yards," said Liccardo.

Pot club operators were wary.

"Anybody who is not on that list, they're going to have to take legal action to shut them down, so that could easily be a lawsuit against 90 or more collectives, " says Dave Hodges of All American Cannabis Club.

Michael Hoveland of Med Ex Collective says the number of dispensaries needs to fit the actual demographics of the city.

"I mean a million people and have 10 dispensaries?" asked Hoveland. "It doesn't make sense."

The city council is scheduled to decide next month on how many pot clubs will stay in business. Some clubs are already considering litigation.
