Poway, CA--The Poway City Council will meet for a special session Friday to consider an extension to the 45-day ordinance banning medical marijuana dispensaries, collectives and cooperatives.
The proposed ordinance, which was removed from the Aug. 2 agenda, asks to extend the interim urgency ordinance that was adopted on July 6 prohibiting the establishment of such businesses until a "detailed" land use study is completed by city staff.
According to the city report, staff has done much work since the July 6 ordinance was adopted granting Poway 45 days to temporarily prohibit medical marijuana dispensaries, collectives and cooperatives. The report notes that staff has studied the regulation of the medicinal drug in other California cities while the city attorney's office has monitored "legal developments concerning the operation and regulation."
The report, which includes a staff recommendation to extend the prohibition by another 10 months and 15 days and could possibly be extended to two years if another ordinance is adopted, notes that "it would be destructive of the proposed regulations, if during the period they were being studied and are the subject of public hearings persons were allowed to establish uses in the city in a manner they might defeat."
The City Council's move to temporarily prohibit medical marijuana dispensaries on July 6 meant one businessman who applied to open up shop was denied.
According to Lake A.P.C. attorney Jessica McElfresh, her client applied for a business permit to open a dispensary in April but was denied. In mid-June, she sent a letter to city leaders but did not hear back.
The meeting will take place at the Council Chambers at 4 p.m. on Friday.
