A ruling by the 5th District Court of Appeal has gone against Kern County's efforts to ban medical marijuana dispensaries.

The court ruled the county erred in its interpretation of Measure G, a ballot initiative that limited where medical marijuana dispensaries could operate.

When Measure G was ruled invalid in an earlier court ruling, the county then took the stand that dispensaries were illegal altogether. The court said this was a violation of the elections code.

The county has 30 days to appeal this latest court ruling.
