FL: Winter Park Bans Medical Marijuana Dispensaries

City commissioners voted in favor of banning medical marijuana dispensaries within Winter Park at a meeting Monday afternoon.

The measure, which repealed and replaced the city's previous rules on medical cannabis, passed by a 4-1 vote with Commissioner Sarah Sprinkel voting in opposition.

"It was a constitutional amendment that 71 percent...voted in favor of," Sprinkel said of her vote.

Mayor Steve Leary noted that people have access to medical marijuana at Knox Cannabis Dispensary in nearby Orlando, and opted to vote against allowing a similar dispensary in Winter Park.

Municipalities across Central Florida are considering their options after state lawmakers approved rules giving local governments grounds to ban the dispensaries, or allow them but regulate them no differently than pharmacies.

The city's planner said in a prior planning and zoning meeting that there is more than 600 acres of land where pharmacies – and potential dispensaries – would be allowed to build, meeting minutes show.

The reaction to the state rules has been mixed across the region, with Winter Garden banning the dispensaries while Oviedo decided to allow them. Officials in Apopka plan to discuss a ban at a meeting Wednesday.

Seminole County also is considering a ban, while the City of Orlando is still studying the issue.

Seventy-one percent of voters approved the medical marijuana amendment in November, which allowed for marijuana to be used to treat patients with cancer, chronic pain, epilepsy, HIV/AIDS, post-traumatic stress disorder, multiple sclerosis and other debilitating conditions.

No members of the public spoke on the issue Monday.

Winter Park's previous regulations were passed in 2014 and imposed "reasonable restrictions" on treatment centers.
