The president of an Upland-based medical marijuana dispensary and his brother will soon be released on bond but will be confined to house arrest.
Rancho Cucamonga residents Aaron Sandusky, 41, president of G3 Holistic, and Keith Alan Sandusky, 44, who was in charge of day-to-day operations at G3, were granted the ability to post bond, according to U.S. District Court records filed this past weekend.
The Sanduskys and four other employees pleaded not guilty last week to drug-trafficking charges in U.S. District Court in Los Angeles. They were arrested June 14.
The federal government had tried to keep Aaron Sanducky in jail on an appeal of the bond, but Judge Percy Anderson denied that request, according to the records.
"The government was vindictive to the extent it wanted detention - no bail. That was rejected," Aaron Sandusky's attorney Roger Jon Diamond said.
Bond was set for $200,000 for Aaron Sandusky, 41, and $50,000 for Keith Sandusky, 44.
Aaron Sandusky is expected to be released by mid-week because of the time it takes to get $200,000 of signed bonds, Diamond said. His brother was expected to be released Monday.
With the federal bond, "it's more complicated with sureties to sign things, a deed to be submitted, a title report and tax assessment report," Diamond said.
The Sanduskys will be on house arrest with electronic and alcohol monitoring units among other restrictions, according to the records.
According to an indictment filed June 6 in U.S. District Court in Riverside, the six defendants in the case were charged in a conspiracy to manufacture and to possess with intent to distribute marijuana.
G3 had sites in Upland, Colton and Moreno Valley.
The indictment also charges all the defendants with possession with intent to distribute marijuana. The two charges each carry a mandatory minimum sentence of 10 years in federal prison and a maximum sentence of life in prison.
A Riverside federal judge on June 15 set the Sanduskys bail amounts, but the U.S. Attorney's Office appealed the setting of bond in order to keep them in custody.
The judge in Riverside decided to have a Los Angeles judge review the case and weigh in June 18.
But transcripts or recordings from the June 15 hearing were not yet made available in a timely manner by the Riverside court. Those documents were reviewed by the Los Angeles judge late last week.
A trial for the Sanduskys and the four other G3 employees has been set at 8:30 a.m. Aug. 7 in U.S. District Court, 312 N. Spring St., Los Angeles.
The other four workers:
G3-co-founder John Leslie Nuckolls II, 31, of Rialto.
Brandon Anton Gustafson, 30, of Yucaipa, who worked at an Ontario warehouse associated with G3.
Paul Neumann Brownbridge, 29, of Upland, who worked at the warehouse.
Richard Irwin Kirchnavy, 45, of Rancho Cucamonga, who also worked at the warehouse
