Medical marijuana has had a tumultuous journey in Montana, catching thousands in its cross hairs.

The Medical Marijuana Act, initially passed by a majority of Montana voters in 2004 was revamped by the 2011 Legislature and the controversy surrounding cannabis is far from over as voters have a choice to now ratify or repeal with Initiative-124, regarding medical marijuana regulation.

The fate of medical marijuana regulation is in the hands of voters.

"If they'll take away our voice once, they'll take it away again," says Hiedi Handford with Lets Connect USA.

Medical marijuana advocates favor an "against vote," those planning to say "no" to Initiative-124 say the current form of medical marijuana regulation, Senate Bill 423, punishes patients.

"The very people we voted it for, to have medical marijuana in 2004 are the very ones that will not have access under SB 423," adds Handford.

Senate Bill 423 mandates that providers distribute marijuana to no more than three patients without any compensation, the bill's sponsor says these aspects return regulation to what voters initially wanted in 2004.

"Number one issue they need to decide is whether they wish to return to the circus that we had going on in the state of Montana," says Senator Jeff Essmann (R — Billings.)

Despite what many describe as confusing ballot language, a "for" vote supports what's in place now, SB 423, an "against" vote repeals it.

"One initiative, it's the voice of the people and the will of the people and what they've done with IR-124 is take away our voice," adds Handford.

"Our intent was to take the program back to what was presented by the proponents of medical marijuana in the voter information pamphlet of 2004," says Senator Essmann.

While both sides of the aisle disagree on what Montanans really wanted eight years ago, opponents of the initiative say a no vote is the will of the voters, while proponents of IR-124 claim the measure is a "workable means of access. "
