Judge Orders Mountain View Pot Club To Shut Down

Buddy's Cannabis Patient Collective, a medical marijuana dispensary that opened in Mountain View in April despite a city ban on such businesses, was ordered to close today by a Santa Clara County Superior Court judge.

Judge Joseph Huber granted the city's request for a temporary injunction against Buddy's. The injunction will shutter the dispensary until its legal fight with the city is resolved. Huber did not explain his reasoning in the brief, two-page ruling.

The ruling says Buddy's must close by 5 p.m. on July 7. Its founder, former corporate lawyer Matt Lucero, said the dispensary will remain open until then and that he will continue with court proceedings, hoping to eventually reopen Buddy's at its Mountain View location.

"We're not giving up on Buddy's Mountain View," Lucero said. "Obviously we're going to respect the judge's decision and we'll comply with it fully, but we're not giving up on a Mountain View location and we're not giving up on Mountain View residents."

Meanwhile, Lucero said, he is working to open a larger medical marijuana dispensary in San Jose before July 7.

Mountain View City Attorney Jannie Quinn said the city is "very pleased with the ruling.

"The city just feels it's unfortunate that Buddy's chose to open in violation of the ban and before the city council really had an opportunity to formulate an ordinance," she said.
