Leoni Township Planning Commission Will Discuss Medical Marijuana Moratorium Wed

The one-year medical marijuana moratorium in Leoni Township is set to expire soon and township planning officials will discuss what to do next.

The discussion will take place at the 6 p.m. Wednesday Feb. 6 Leoni Township Planning Commission meeting at the township hall, 913 Fifth St, Michigan Center.

An extension on the moratorium is not out of the question, Leoni Township Planning Commission Chairman Doug Sink said. The moratorium expires May 8.

The initial plan was to adopt a zoning ordinance that would regulate where new businesses could be located. Some ideas were either a light or heavy industrial zone.

That is not the plan anymore.

"From what I understand the concept was shot down by the courts in the city of Wyoming," Sink said of creating a zoning ordinance.

Last year the Michigan Court of Appeals ruled that an ordinance banning the use of medical marijuana in the city of Wyoming was illegal. The court said Wyoming's ordinance regulating marijuana goes against the will of state voters who approved medical marijuana at the polls in 2008.

During the temporary ban in Leoni Township, planning officials decided to hold off on creating and adopting an ordinance and instead kept an eye out on how the issue has unfolded in other communities in the state that also have moratoriums.

Sink said he supports restricting the businesses from opening in residential areas.

"Whether it's enough I don't know, we could also keep the moratorium," he said.

The moratorium prohibits "the growth, sale, or dispensation of medical marijuana from any clinic, dispensary or other facility that does not already exist."

During the meeting, the planning commission will also take a look at the newly printed township master plan. Besides the addition of photos, Sink said nothing changed in the plan. Townships are required to address its master plan every five years, even if no changes are made.

"We just got the printed copies back, it looks very nice," Sink said of the master plan.
