MA: Special Town Meeting Bans Marijuana On Public Land

Marijuana will be banned from all town land after special town meeting voters decided Tuesday to amend the general bylaws. All consumption of marijuana or tetrahydrocannabinol (THC), the active ingredient in marijuana, will be banned anywhere in town alcohol consumption is already banned, including playgrounds, parks, beaches, sidewalks, public parking lots and sand spits.

Approval of the selectmen-proposed bylaw also allows violators to be fined $300 for each offense. The article was approved unanimously with no discussion.

A moratorium on recreational marijuana distribution is in effect in Scituate until Nov. 30, 2018.

Residents approved the town to take a $500,000 low-interest loan from the state Seawall Loan Fund. The town would spend the money on replacing 756 feet of sea wall on Oceanside Drive, between 7th and 10th streets, town Public Works Director Kevin Cafferty said.

Town meeting voters also decided to allot $528,500 the Community Preservation Committee to construct access roads and parking areas at the Bates Lane Complex off Clapp Road, the Higgins-McAllister property on Holly Crest Road, the Damon Memorial property on Clapp Road and the Crosbie property, also on Clapp Road.

An additional $329,665 in funding was approved to replace windows at Central Park housing complex and to map new and existing trails on Scituate conservation property, to print maps, to design signs and to install trail markers.

An article that asked for permission for the board of selectmen to designate town property for conservation purposes was postponed.

The article was drafted in the wake of a dispute with the state attorney general's office, which says the town improperly used conservation land as the site for its new public safety complex. As a result, Scituate must find 7 acres of land to place into conservation.

The board is considering placing land near Tack Factory Pond into conservation.

"We're in the middle of doing our due diligence on that now, it's just too early to come before the town," selectman Anthony Vegnani said.
