Marijuana-Related Ordinances On Fort Morgan City Council Agenda

The Fort Morgan City Council will consider two possible ordinances related to recreational marijuana at the regular meeting at 6 p.m. Tuesday at City Hall.

The first one would establish a local licensing authority for marijuana-related establishments.

The second would prohibit commercial marijuana operations within Fort Morgan.

The council held three public forums last spring to gather feedback from residents on the direction it should take regarding regulation of or banning commercial marijuana in the city.

While there were speakers both for and against allowing commercial marijuana facilities of various types, the majority seemed to be against the idea.

Whatever action the council would take Tuesday would not affect the rights granted by Amendment 64 for Colorado adults to possess and grow small amounts of marijuana for personal, recreation use. There also would be more than one council vote required before either or both proposed ordinances would be finalized.

Contractors' forum

The council also will hear staff recommendations that came out of what staff and council members heard at the contractors' forum held in April to determine why residential housing was not being built in the city.

Those recommendations could include simplifying how contractors need to work with various city departments and potentially changing how the city's use tax is applied and when it is collected. Staff wanted more council direction on the latter, though, according to a city memo.

Changes to the way the Building Department is structured also were listed among possible changes resulting from the forum.

Water items

The council also will consider several items related to water, including:

Possible first action on an ordinance that would amend City Code regarding water tap abandonments and allow more flexibility concerning timelines and foreclosures.

Possible action on a resolution authorizing an intergovernmental agreement with Morgan County Quality Water District regarding water service within the MCQWD service area; this would clear the way for Community Resource Housing Development Corporation's proposed housing development to be built by the Morgan County Human Services Building by capping an old, unused MCQWD line and allowing the Banner Health Clinic to continue to receive water service from the city, even though it is not located in the city.

And possible action on bids for water tank painting and stair addition at the Water Treatment Plant.

Other agenda items

The council also will:

Hear the recognition of Fort Morgan Police Det. Loren Sharp as the city's employee of the quarter.

Consider appointing Matthew Sharp and Betsy Porter to fill vacancies on the Library Advisory Board.

Consider final action on second reading of an ordinance amending the 2012 city budget.

Hear the presentation of the city's draft 2012 financial audit.

Hear a presentation and consider action on a proposed resolution authorizing a memorandum of understanding with Intervention Inc. for probation services for Fort Morgan City Court; this would mean outsourcing probation services to save the city money by eliminating a full-time position.

Consider action on a resolution authorizing a settlement agreement under the Americans with Disabilities Act.

Consider action on a resolution authorizing a pole attachment agreement with Kentec Communication Inc. for providing Internet service in the city.

Hear about proposed updates to the 2014 budget calendar.

Hear a presentation and consider action on mid-year 2013 budget adjustments.

Hear a presentation on the 2014 Capital Improvement Fund and Conservation Trust Fund and proposed expenditures in both.

Hold an executive session to determine positions related to negotiations, develop strategy and/or instruct negotiators in regard to purchasing replacement power through Western Area Power Administration.

Hold an executive session to determine positions related to negotiations, develop strategy and/or instruct negotiators in regard to purchasing water.
