Massachusetts' New Marijuana Law Gets Unusual Test

Charges against an MCI-Shirley inmate caught with marijuana in his cell have been dismissed in Ayer District Court Wednesday based on a change in state law that de-criminalizes possession of small amounts of the drug.

Meanwhile, both his sister and girlfriend face possible jail time for smuggling it in.

The Sentinel & Enterprise reported that on July 10, Tina Fair and Sepia Guest visited inmate Marcus Guest. Prosecutors say Fair had hidden a balloon containing the marijuana in her bra. Then, with Sepia Guest shielding her, Fair put the balloon into a bag of chips she passed on to Marcus Guest, who then appeared to be taking chips from the bag, but was instead putting the balloon in his mouth.

The whole transaction was caught on videotape. Later, in a search of his cell, the balloon was found in Guest's shorts. When it was tested, it was found to be under an ounce.

A change in the law that went into effect last January de-criminalized the possession of an ounce or less of marijuana.
However, bringing drugs in to a prisoner is still a crime. Each woman faces a maximum two years in the House of Correction and a $1,000 fine. Both pleaded innocent.

Possessing less than an ounce of marijuana may no longer be illegal, but it is still against prison rules, and Marcus Guest faces disciplinary action.
