The attorney for the Montana Cannabis Industry Association has filed a petition to remove Judge Kathy Seeley from the case that looks to overturn Montana's new medical marijuana law.

A substitution of judge petition was filed this morning by Bozeman Attorney James Goetz. Judge Seeley, the state and the association were scheduled to have a conference this afternoon on the association's petition to repeal the law. A new judge has yet to be named to the case.

The association is petitioning Senate Bill 423, which will bring sweeping reform to the medical marijuana industry. Governor Schweitzer let the bill go into law without his signature last week and it will go into effect July 1st. Another hearing is set for this Friday, but it's unclear if that will still be held once a new judge is named.
