Medical Marijuana Dispensaries In Longmont Lose Fight To Reopen

LONGMONT, Colo. – Medical marijuana dispensaries in Longmont have lost their fight to reopen after a city ban.

The Daily Times-Call newspaper reports that Boulder District Judge Ingrid Bakke dismissed a lawsuit from three dispensaries on Friday (Judge dismisses marijuana case against Longmont - Longmont Times-Call). Bakke ruled the ban neither violated constitutional rights nor constituted an illegal "taking" of property.

New Age Wellness, Colorado Patients First and The Longmont Apothecary sued the city in July. They sued after a failed petition to put a repeal of the dispensary ban on the November ballot. All three closed on Aug. 19.

Longmont issued a moratorium on new marijuana-related businesses in October of 2009 and approved a complete ban last May.
