Medical-marijuana Moratorium Extended for 60 Days in Kalamazoo Township

The Kalamazoo Township Board Monday night voted unanimously to extend for 60 days the local moratorium on rules for the possession, use and sale of medical marijuana.

The deadline had been April 18, but after a public hearing March 14 on a proposed ordinance drew a great deal of opposition, township Supervisor Terri Mellinger moved to extend the moratorium by two months to allow for alternative approaches to the local ordinance and to allow for more input from medical marijuana advocates.

The new deadline now is June 17.

The township board accepted the first reading of the moratorium extension March 28 night to give Township Attorney Kenneth Sparks and a special committee more time to consider alternatives.

A large group of local residents appeared at public hearings in October, February and March to insist local rules not conflict with the ballot proposal passed statewide by a wide margin in November 2008.

Some have even threatened legal action if ordinance proposed in February is adopted because they say it violates state guidelines.

Advocates particularly have opposed restricting growers to commercial and industrial areas if they are providing for more than just themselves or one person living in the same household.

They have insisted that such restrictions would cause economic hardship on small-time growers providing medicine to patients and growing in residential areas. They also have claimed preliminary work on a local ordinance has not included any medical marijuana advocates.

The new state law allows providers to grow up to 12 plants per patient for up to five registered patients.
