Medical Marijuana Moratorium Extended Into April In Texas Township

TEXAS TOWNSHIP – A moratorium on medical marijuana operations in Texas Township that originally was set to expire Oct. 19 now will continue into April.

The township board enacted a six-month moratorium last April to give the planning commission time to establish how the township could and should regulate the growth and distribution of medical marijuana.

At its meeting Monday, the township board unanimously extended the moratorium an additional six months in hopes actions at the state level will make a local ordinance to regulate the sale and dispensation of medical marijuana in the township unnecessary.

The moratorium does not apply to registered patients growing their own marijuana in their homes, caregivers cultivating marijuana in their homes for one patient who is a member of the same household or caregivers assisting patients in the patient's residence. The intent was to address cooperatives where multiple caregivers grow medical marijuana together in one location and medical marijuana businesses where medical marijuana is often transferred from patient to patient.

The Michigan Court of Appeals in August ruled that the state's medical marijuana act does not permit dispensaries that operate as patient-to-patient sales centers. The ruling is subject to appeal.

The Michigan Medical Marijuana Act allows registered medical marijuana patients to cultivate a limited number of plants for their own use or to specify a caregiver, who can supply up to five patients.

Many municipalities have struggled with how they can and should regulate the dispensaries, cooperatives and patient-to-patient transfers that have proliferated since 2008, when voters passed the act many have characterized as vague.

Texas Township officials consider it likely that the state Legislature will amend the act in the next six months. The planning commission and township board plan to monitor additional attorney general opinions, case law and statutory amendments.
