Escanaba, MI - The first medical marijuana case in Delta County will not go to trial. Jason McEntire of Escanaba pled no contest to maintaining a drug house and had the other marijuana charges dismissed.

In April, the 37-year-old McEntire was arrested for delivery, manufacturing marijuana and maintaining a drug house. But he says he was using the marijuana for medical purposes.

McEntire accepted a plea deal that dismisses the delivery and manufacturing charge, which is a four year felony, along with habitual offender charges.

His attorney feels it was the best route to take since McEntire possessed 15 potted plants.

"It was certainly the best resolution for Mr. McEntire as opposed to going to trial and having the risk of being convicted of the 4 year felony because he had 3 extra plants. If he would have only had 12 plants, then we would have had more of an argument to have the matter dismissed under the medical marijuana law," said defense attorney Jayne Mackowiak.

McEntire will be sentenced within the next six weeks.
