Napa DA: Drug Agents Justified In Fatal Shooting

NAPA, Calif. -- Napa County District Attorney Gary Lieberstein says the fatal shooting of a suspected pot grower by two drug task force agents was justified.

Lieberstein said Thursday the agents had reason to believe their lives were in danger when they fatally shot Jose Luis Chavez Martinez in the hills near Lake Berryessa on June 30.

The shooting occurred after Napa County Sheriff's Deputy Jeremiah Bohlander and Napa Police Officer Pete Piersig saw Martinez and another man near a suspected illegal pot grow.

Lieberstein says the agents yelled out to identify themselves. He says Martinez then reached for a silver object in his waistband before running toward nearby bushes.

The agents opened fire, and later found a chrome-plated .38-caliber revolver beneath Martinez.
