The BILL NUMBER: A6357E allows the residents of the New York to use Medical Marijuana under its Medical Marijuana Program for the treatment of pain and suffering of those who are in a desperate need under certain specified conditions.

Qualifying Conditions: Currently, patients can be eligible if they have been diagnosed with one or more of the following severe debilitating or life-threatening conditions: New York State Department of Health Announces Opioid Use to be Added as a Qualifying Condition for Medical Marijuana

· Opioid Overdose
· Chronic pain.
· Cancer;
· HIV infection or AIDS;
· Amyotrophic lateral sclerosis (ALS);
· Parkinson's disease;
· Multiple sclerosis;
· Spinal cord injury with spasticity;
· Epilepsy;
· Inflammatory bowel disease;
· Neuropathy ;
· Huntington's disease;
· Post-traumatic stress disorder;

Procedure:
The patients willing to avail medical marijuana treatment, are required to get themselves certified by an Authorized Practitioner that he is having any of the above conditions he should be registered with the Department of Health, New York for medical marijuana purchases for improvement in the health.

· Certification from a registered/ authorized practitioner is essential.
· After getting certified, the patient may request online to the Department of Health for a Registry Identification Card. The Department of health may approve his request and issue Registry Identification Card.
· The applicant-patient should expect to receive his Registry Identification Card within 7 days.

How To Get The Registry ID Card:


1. Patients must first be certified by a registered practitioner
2. Once certified, patients must login to Welcome to My NY.gov Online Services
Patients who do not have an NY.gov account will need to click the "Don't have an Account?" button to create a personal NY.gov ID first.
3. Click the "Health Applications" icon, and then click the "Medical Marijuana Data Management System" link to register For step-by-step instructions on how to register as a patient or caregiver, select the "HELP" link within the Medical Marijuana Data Management System or click here for instructions.
Patients will be required to provide proof of their identity and residency during the application process. Click here for additional information regarding required documentation.
Pursuant to the Compassionate Care Act there is a $50 application fee; the Department is currently waiving the $50 fee for all patients and their designated caregivers. Simply select "Bill Me Later" when registering and the application fee will be waived.
4. Patients may designate up to two caregivers during the registration process. After the patient's registration is processed, the designated caregiver(s) must then register with the Department using the same online system described in number 2 above.
5. Once a patient or caregiver's registration is processed, the Department will mail a registry identification card (ID card) directly to the patient or caregiver. Registrations expire when the certification that was issued by the practitioner expires.
6. Patients must bring their registry ID cards and their certifications to a registered organization's dispensing facility in order to purchase approved medical marijuana products. Designated caregivers obtaining medical marijuana on behalf of their patients must bring their caregiver registry identification cards and their patients' certifications to the dispensing facility.

Other Important Registration Information:

• Certified patients and designated caregivers must always carry their registry ID card whenever they possess approved medical marijuana products.
• Medical marijuana products may not be transported outside of New York State.
• New York State does not accept certifications or registry ID cards from other states.
• A certified patient or designated caregiver who has been issued a registry ID card must notify the Medical Marijuana Program of any change in his or her name, address, or if he or she no longer has the serious condition noted on the card within ten (10) business days of such change.

Minors:
If the applicant for a registry identification card is under the age of eighteen (18) or a person who is otherwise incapable of consenting to medical treatment, the application must be submitted by an appropriate person over twenty-one (21) years of age.
The applicant must designate at least one, and up to two, caregivers who must be among the following:
(i) A parent or legal guardian of the certified patient;
(ii) A person designated by a parent or legal guardian; or
(iii) An appropriate person approved by the Department upon a sufficient showing that no parent or legal guardian is available or appropriate.
Patients Who Are Not Residents of New York:
If you are a non-New York State Resident temporarily residing in New York for the care and treatment of a serious condition, and you have been certified by a practitioner registered in New York State, you must provide documentation showing proof of temporary residence in New York State. Examples include, but are not limited to:
a copy of a lease;
a utility bill;
a hospital bill; or
other documentation as approved by DOH, which contains sufficient information to show proof of temporary residency in New York State.
Medical Marijuana Program Certified Patient and Designated Caregiver Registration Requirements
Caregivers’ Identification Card:
· During the registration process, the certified patient can designate up to 2 caregivers who can buy medical marijuana products on his behalf.
· The caregivers will also apply for registration separately & obtain an Identification card to buy medical marijuana products on behalf of the patients.
· Designated caregivers with a valid registry identification card may assist the patient with the possession, acquisition, delivery, transfer, transportation and/or administration of approved medical marijuana products.

Types of caregivers:
The caregiver could be:
a) An Individual
b) An Institution/ or an organization that could be a:
· a general hospital or residential health care facility operating pursuant to Article 28 of the Public Health Law
· an adult care facility operating pursuant to Title 2 of Article 7 of the Social Services Law
· a community mental health residence established pursuant to section 41.44 of the Mental Hygiene Law
· a hospital operating pursuant to section 7.17 of the Mental Hygiene Law
· a mental hygiene facility operating pursuant to Article 31 of the Mental Hygiene Law
· an inpatient or residential treatment program certified pursuant to Article 32 of the Mental Hygiene Law
· a residential facility for the care and treatment of persons with developmental disabilities operating pursuant to Article 16 of the Mental Hygiene Law
· a residential treatment facility for children and youth operating pursuant to Article 31 of the Mental Hygiene Law
· a private or public school
Where to Obtain Medical Marijuana Products:
The registered patients & the caregivers holding a valid Identification Card can purchase medical marijuana products from the Registered Medical Marijuana Organizations who are authorized by the State Health Dept. for dispensing medical marijuana products in New York.
