Northville Puts Moratorium on Medical Marijuana Dispensaries

The Northville City Council has put a moratorium on medical marijuana dispensaries for six months and further added the Planning Commission would be directed to investigate possible zoning ordinance amendments for the purpose of regulating future medical marijuana sale and dispensation.

This resolution is in response to some of the after effects from the passing of the state-wide legalization of medicinal marijuana act in 2008.

"While the act made medical marijuana legal under state law, it failed to address the details of how it would be dispensed," Northville City Manager Patrick Sullivan said to the council. "The absence of detail in the new law, and the fact that this activity was never contemplated when local zoning ordinances were developed has resulted in confusion."

There will be no permits, licenses or approvals on anything regarding the sale or dispensation of medical marijuana within the city limits during this time period. Sullivan said the issue has become a challenge for many communities trying to figure out how to regulate it. Zoning ordinances have become one way to potentially regulate what is still considered illegal at the federal level.

He said, "Some communities have already adopted such amendments and these could be used as a guide for our Planning Commission. It is also possible that the legislature could address the deficiencies in the act and clarify some of the issues for us."

Adding that the six month time period should allow time to develop proper standards and restrictions for medical marijuana dispensaries.

The planning commission will begin to look at this in the next couple of months and will eventually put something in front of the council before the six months end.
