OH: Sheffield Village Council Passes Marijuana Ban

Anyone planning to profit off of the new medical marijuana market in Sheffield Village, will have to find a new place to set up shop.

In their final meeting for 2016, the Village Council voted 5-1 on Dec. 12 to revise its zoning code banning the cultivation, processing and retail dispensing of the drug in the zoning districts of the village.

The ban follows the legalization of the drug which Gov. John Kasich signed into law June 9. The village passed a six-month moratorium on the matter to give it time to craft its own legislation, according to Mayor John D. Hunter.

The state legislation left too many caveats and did not give municipalities the time to set their own legislation to decide whether they wanted the drug produced or sold in their limits, thus the six-month ban, Hunter said.

During that time he state further mismanaged the new law and the council decided that it was better not to have it at all.

"The Council took action to say, 'look, we're just not going to have it cultivated, sold or zoned anywhere in the village,'" he said.

If the Council chooses at a later date to lift the ban, members will need to repeal the ordinance, according to Hunter.
