Owners of a recently opened Rainier medical marijuana dispensary said Thursday they haven't been ordered to close shop and they plan to stay open, even though federal officials have told many Oregon dispensaries to close their doors immediately.
Staypuff Organics, which opened in April, didn't receive a June 3 letter from the U.S. Attorney's Office threatening legal action, said Lori Neveau, who owns and runs the operation at 113 E. First St. with her husband, Ron, and their adult son Ryan.
The letter was sent out to dozens of Oregon dispensaries, including the Big River Cannabis Club near Scappoose. The Clatsop County sheriff's office warned Nature's Choice Alternative Medicine in Astoria on Wednesday that its operation may be illegal, according to The Daily Astorian newspaper.
This month, authorities across the state have launched a crackdown on marijuana dispensaries. Citing concern over a "breathtaking surge" in medical marijuana shops popping up statewide, U.S. Attorney Dwight Holton joined local law enforcement officials in notifying some dispensaries that they are breaking state and federal laws that prohibit the sale of marijuana.
Oregon law allows limited marijuana use for residents who obtain Oregon Medical Marijuana Program cards through doctors' prescriptions. Cardholders can grow their own plants or they can get marijuana from a registered grower.
Under the hazy law, registered growers such as Staypuff can be reimbursed for the cost of producing the marijuana, but they aren't allowed to sell it to customers.
Neveau said Staypuff follows those laws.
Owners and operators of illegal dispensaries may be charged with manufacture and distribution crimes, according to the letter sent from the U.S. Attorney's Office.
