Rancho Says 'No' To Pot Shops For At Least 45 Days

RANCHO SANTA MARGARITA, CA. — Medical marijuana shops in the city are in violation and others seeking to operate there will be turned away.

The City Council on Wednesday unanimously enacted a temporary moratorium on medical marijuana shops from opening in the city for at least 45 days. The decision puts the moratorium into effect immediately while city staff investigates the associated land-use issues.

During the moratorium, pot shops will be forbidden to establish, operate or get a permit to exist in the city, City Attorney Greg Simonian said.

City staff will study and evaluate regulatory options for medical marijuana dispensaries and make recommendations to the City Council as that relates to the city's zoning code. According to the city's current zoning code, dispensaries are a prohibited use in the city.

The request to issue the moratorium was brought to the council following the establishment of two dispensaries within the city and requests from other dispensaries to locate within the city, Simonian said.

Simonian said staff will consider impacts from dispensaries in other cities and statewide.

There was no input from the public in the discussion.
