SD: Panel OKs Medical Marijuana Extract, Strikes FDA Provision

Pierre – A South Dakota panel on Wednesday approved a measure aimed at legalizing a medical marijuana extract used to treat severe seizure disorders.

The House Health and Human Services Committee on a 7-3 vote approved Senate Bill 95, which would reschedule cannabidiol, a derivative of marijuana that doesn't create a sensation of being high, with the hope of allowing more parents to administer the drug to children with severe seizure disorders.

The committee also added an amendment that would eliminate a provision that troubled the measure's supporters. The bill had been altered in a Senate committee to require U.S. Food and Drug Administration approval prior to cannabidiol being rescheduled as a Class 4 drug.

Representatives in the House committee struck that requirement, which opens up the possibility for families to legally possess and use any prescribed cannabidiol product. The bill would also separate the derivative from the state's definition of marijuana, once the FDA signs off on a cannabidiol drug.

Parents of children with severe seizure disorders, medical cannabis advocates and the bill's sponsor Sen. Blake Curd, R-Sioux Falls, considered the bill's passage without the provision a win. Meanwhile, opponents of legalizing CBD and representatives from GW Pharmaceuticals and its U.S. branch Greenwich Biosciences, Inc., said eliminating the FDA approval requirement didn't make sense.

Legislators on the committee said they would consider a hoghouse amendment to more directly allow people with seizure disorders to access the drug in certain circumstances, even before the FDA approves it.

The bill moves now to the House for a vote. If approved there, it will be consolidated with the copy that was approved by the Senate in a conference committee.
