Shouldn't Patients define Adequate Supply?

"Last Friday, Santa Fe District Judge Sarah Singleton agreed to send [Secretary Retta] Ward a writ of mandamus compelling the secretary to 'take steps to ensure an adequate supply' of medical cannabis to patients in the program, which is supposed to be enforced under the Lynn and Erin Compassionate Use Act that legalized medical marijuana in New Mexico.

If Springer disputes that that DOH still isn't meeting patient demand by September, Ward will then have to prove the contrary in front of court."

The Compassionate Use Act defines an adequate supply as "...an amount of cannabis, in any form approved by the department, possessed by a qualified patient or collectively possessed by a qualified patient and the qualified patient's primary caregiver that is determined by rule of the department to be no more than reasonably necessary to ensure the uninterrupted availability of cannabis for a period of three months and that is derived solely from an intrastate source."

Isn't it past time for the DOH to re-examine what constitutes an adequate supply for medical cannabis patients?
