just a quick question? for a state, whos athority is higher for the people? the federal law, or the state?
 
Federal. However, originally, it was intended to be the opposite. Certain issues like slavery, basic human rights and freedoms for all had to be implemented and maintained at the federal level to protect people from direct harm or discrimination.

We have taken these powers and used them to control everyone, and deny the basic human freedoms and rights that founded our great nation. The exact opposite of what was intended for federal law and regulation.
 
thanks boss-g. seems like we need a big change. like legalization of weed. just to get people back on the same page. yaknow!? it seems. i dunno. but the great evolution of one main interest fueled by communications finaly here.. so lets all get stoned and, figure out how to get out of our galaxy before it emplodes, or is that even possible!?the world needs a foundation.weed is this tool.
 
Well if a state votes for a law to be passed, such as legalization of medical marijuana in California, the federal government, under the constitution, has no jurisdiction. The feds don't really follow that rule though...
 
If the supreme court says abortion is illegal, even if states pass laws saying it's legal, you can still be prosecuted under the federal law. Federal Law takes precedence, always.

As for Marijuana, if a state makes it legal, you can be prosecuted under Federal law, but State agencies such as local and state law enforcement, cannot aid the federal government in any way. (They still do, but they are not allowed.)

Seeing as the laws were passed by the taxpayers in the state, and all state law enforcement is paid by the state taxpayers, it makes perfect sence. But that does not stop dpartments such as homeland security, the FBI, or the ATF from enforcing federal law.

The legality of interracial marriage.
Clean Air Act
Miranda Warnings
A defendant's right to a lawyer in criminal cases involving state laws.


Those are all examples of federal law being the supreme law of the land.

Care should be taken when deciding which babies to throw out with what bathwater.

This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.
