A western Minnesota mother will no longer face charges of child endangerment for giving her ailing son medical marijuana, the Pioneer Press reports.
Angela Brown, from Madison, was charged with two gross misdemeanors for treating the 15-year-old's severe pain, muscle spasms and seizures with cannabis oil.
But this week, Judge Thomas Van Hon ruled there wasn't enough reason to go forward with the child endangerment charge — a gross misdemeanor — and dismissed it, the West Central Tribune reports.
Brown will still face charges of "contributing to the need for child protection" — basically, doing something that causes officials to say the child needs protection, or another service. That is also a gross misdemeanor.
Last month, she asked the court to simply dismiss the case.
Her son, Trey Brown, suffered a traumatic brain injury when he was hit in the head with a line drive during a baseball game three years ago. She bought the teenager cannabis oil in Colorado, and when used, say he experienced significant relief from his symptoms.
The charges came just months after the Minnesota Legislature approved a medical marijuana bill that will give certain patients access to marijuana in pill or liquid form, if a doctor or physician's assistant approves.
The new law will take effect in July.
