Wyoming Court: Man Gets Year In Prison For Selling Marijuana

A Silver Springs man convicted of selling marijuana was sentenced Thursday to a year in Wyoming County Jail.

Michael J. Regatuso II, 29, in a July 15 appearance in Wyoming County Court, pleaded guilty to fourth-degree criminal sale of marijuana, a Class A misdemeanor, for selling a small quantity of pot March 12 in the town of Gainesville. Wyoming County Judge Mark H. Dadd, during Thursday's sentencing hearing, also ordered the defendant to pay $100 restitution to the Wyoming County Drug Task Force.

A Wyoming County grand jury had returned drug indictments in July against the defendant and his father, Michael J. Regatuso, 49, also of Silver Springs.

The elder Regatuso was charged with second-degree criminal possession of marijuana, a Class D felony, for possession of 16.7 ounces of pot on March 18 in Gainesville. He pleaded guilty to the charge last month, as part of a plea bargain, on condition he receive a sentence of one year of interim probation and 200 hours of community service.

The elder Regatuso's sentencing hearing is Nov. 4.

Regatuso II's legal troubles aren't over. He was enrolled in Wyoming County Drug Court and on probation when he was indicted this year for selling marijuana. He was then charged with a probation violation and admitted to the violation in a July 21 court appearance.

Regatuso II's proposed sentence in the probation case is 12 months in jail, to be served consecutive to the year he received on Thursday. His sentencing hearing on the probation violation is Oct. 6.

In another case from Thursday's court session, Christopher A. Lowery, 19, of Warsaw was arraigned on a charge of violating terms of his pretrial release. The judge ordered him committed to jail in lieu of $5,000 bail.

The Wyoming County Drug Task Force arrested Lowery May 1 on drug sale and drug possession charges. A plea bargain had been reached in the case, between Assistant District Attorney Donald O'Geen and Lowery's attorney, Public Defender Norman Effman, and Lowery was awaiting sentencing.

While Lowery was under the supervision of the county's pretrial program he was arrested for criminal mischief. He also allegedly tested positive for illegal drugs, did not complete medical treatment and missed his curfew.

His case was adjourned until Oct. 7.
