Florida: Insiders Win While Patients Lose On Medical Marijuana

There is a verb from the Psychedelic '60s that describes a particular kind of selfish act: bogart.

Floridians can slightly adapt the derisive term to describe the behavior of agribusinesses and politicians who are rigging the state's medical marijuana law for the benefit of a few influential people.

Instead of sharing the business — passing it along, as it were — they are trying to "bogart" it for themselves. This selfish act is made particularly disgusting because it has delayed relief to tens of thousands of Floridians expected to benefit from the medical marijuana measure the Legislature passed in 2014.

Rather than adopt an open-market model, the Legislature severely restricted the number of nurseries that would be granted licenses to grow the non-euphoric types of medical marijuana frequently referred to as Charlotte's Web. Not only that, the Legislature adopted criteria for acceptable growers obviously designed to favor certain nurseries.

On Monday, the state Department of Health awarded five licenses to produce an ingestible, low-THC oil. With doctor approval, it will be used to treat patients with epilepsy and cancer. Each license covers a specific geographic area. The license for Southeast Florida, including Broward and Palm Beach counties, went to Costa Farms in Miami-Dade County.

Costa benefited from an amendment to the law that required pot producers seeking a Florida license to have been in business for at least 30 years and to be producing 400,000 plants when they applied for the license — a provision that perfectly describes Costa.

Costa also sued to stop the Health Department's original plan to implement the law, which was to award the licenses by lottery. Why trust luck when you are more likely to prevail when you trust lobbyists? That lawsuit added to delays in relief that was supposed to be available by Jan. 1 of this year, but will not be forthcoming until next summer at the earliest.

And the delays could get even worse. Some of the applicants who did not make the cut are almost certain to sue. They can argue, among other things, that the complex selection criteria, which resulted in applications hundreds of pages long, did not make sense.

And there's another problem. The selection rules were developed with input of some of the growers themselves. Four of the five nurseries chosen to grow the pot had seats on the panel that helped develop the rules. That will give at least initial credibility to any claims in lawsuits that the winners benefited from inside information or undue influence.

Costa Farms was one of the winners that provided input on the rules. The other three winners in that insider group were Hackney Nursery Company of Quincy, Chestnut Hill Tree Farm of Alachua and Knox Nursery of Winter Garden. Alpha Foliage of Homestead was the other grower selected.

There is one possible upside to the selfishness of the businesses that won licenses to produce medical marijuana. To make more money, they will pressure lawmakers to expand the too-narrow list of illnesses and conditions that qualify for treatment.

Some of the decisions could be taken out of lawmakers' hands by a medical marijuana constitutional amendment expected to be on the 2016 ballot. A medical marijuana measure in 2014 that was broader than the current law achieved a majority, but fell just short of the 60 percent required for approval.

We understand that for health and safety there must be strict regulations governing medical marijuana. But the regulations, which should focus on the quality of the end product, have to make sense. A 30-year requirement to get into the business doesn't. And any producer meeting state regulations should be able to compete. Instead, Florida's politicians and business-bogarting producers colluded to pick winners and losers.

The biggest losers so far? Patients who continue to be denied a legal means to end their suffering.

Ok Florida citizens, it's time to start a petition and stop this from happening to you guys! It's your state and we in other states can't do it for y'all although we all wish we could help. Y'all need to be up in arms screaming at the tops of your lungs that y'all aren't going to be monopolized like this...Just sayin'

People of Florida LOOSE AGAIN as big business and rich politicians are setting out to monopolize the MMJ business. In the mean time no patient can get there needed medicine.

Yea guys, I'm starting to see a trend here, first in Ohio now in Florida? Is this the new tactic they're going with so that big brother will still keep control of every aspect of our lives? Sure seems to be panning out like that...watch, I'll bet Georgia tries something along these lines too.

We can yell and scream and sign petitions. We can be civil and educate the general public about the truth. But until the groups who actually are the ones who control the government, figure out how they will get the lions share of the wealth, it will not happen, no matter how many petitions get signed or how many marches or demonstrations we do. They write the bills, Congress and the senate (who are in their pockets), are the ones who either pass or deny the bill. Nothing gets through without their approving it 1st, when they feel that will get the most out of the deal they will pass some sort of law legalizing MJ but not till they know their pockets will get lined. Sorry for being blunt, but thats just the country we live in.

So what do we do? If it's not the people who we actually vote into power really making the laws but instead the lobbyist who we are not voting into power who are actually making all the decisions and laws and controlling our fate? Do we not only advocate for Cannabis but start advocating against lobbyists as well? Are we even focusing our attention in the right direction here? I swear these corporate hijackers are destroying this country from the inside out and seeing to it that this once great country becomes a cesspool that ruins lives and destroys the very fabric of which it was founded upon. We might as well take the constitution out and burn it and start over as a socialist republic if the people are just going to roll over scared and let it happen the way big businesses dictate things need to happen. Why even vote if it's not even the people we're voting for making decisions per the will of the people, maybe voting is just a waste of time and effort? IDK? It's really sad! All the people that have been sent to die to see that this kind of thing doesn't happen and it's happening anyway despite they're sacrifice! What a shitty deal!!!

Outlawing for profit corporations would actually be a good start. We had a form of representative democracy before the rise of corporations (Permanent corporations did not eist when the USA was founded.) Our self government and national wealth do not depend on corporations. In many cases (the medical industry, stock exchanges, moving jobs off-shore) corporate decisions are directly harmful to the national economy and devastating to local economies.

We are used to them, but for profit corporations are a net threat to our natinal government, not a productive part of it.

----

That said, the repeal of marijuana prohibition, is the current 'best' social movement: equivalent to the gay rights and civil rights movements of past years; it is the current next step to taking back our national freedoms and voice in government. Politically, this year, it deserves national, state and local activism.

I do not suggest we do nothing, since that would be in their best interests. I am nearly stating the facts. I remember back when I was a young man, they broke up Ma Bell because they said it was to big, and no one company should monopolize the market. Hmm does the comment "Too big to fail" ring any bells? If we are vocal enough and get the numbers behind us, they will listen, because they fear revolution. But trust me, when they do cave in to our demands, follow the money and the lions share will continue right into the same pockets it always has. Once we get this stupid war on drugs out of the way we need to continue on and rid ourselves of this Citizens United decision by the supreme court. Until a judge from the supreme court over turns this, there will never be any true change, only the illusion of change but in reality it will be the same. Rich getting richer the poor getting poorer and the middle class shrinking till it is nothing more then a page in a history book.

We warned EVERYONE about that bill. The bill only put it in the hands of big brother and EVERYONE was going to get screwed. The writing was on the wall and people still did not see the outcome. Something seem good at the begining but when you have big brother involved the people only get screwed.

Now if you want to put it back into the peoples hands... VOTE FOR THE RECREATIONAL BILL IN 2016.. ALSO THE MEDICAL BILL TO KEEP PRICES DOWN FOR PATIENTS.

This is the ONLY way to get it back in the right direction. Leaving it to you to grow and not have to buy it from big brother or in other words the greedy mother F&^%kers who want control.

VOTE FOR THE 2016 RECREATIONAL AND MEDICAL BILL AND LEAVE THOSE GREEDY FUCKERS OUT IN THE COLD

Yea, these law makers are just showing their true colors that they're only going to pass laws that line their pockets and never do what's morally right for the people that vote them into power. It's ALL ABOUT GREED! Every step of the way, PURE GREED!!! Kiss the peoples asses to get their votes then leave them holding the shit end of the stick, then act like they're doing us all a favor by making laws that only benefit them and make them rich, then sit back and tell themselves that the people are too stupid to realize what they're doing is wrong! I've got news for them...We're not that stupid, we see right through their bullshit! Things are finally shifting in our favor so it's time for them to shit or get off the pot!!! We have got to let them know that we will always continue to keep the pressure on until they start listening to the will of the people, it's not just their world, it's our world too!
