A Colorado woman faces child abuse charges after allegedly admitting to South Dakota law enforcement that she lets her two sons younger than 10 years old consume marijuana edibles.
On July 7, there was a traffic checkpoint on U.S. Highway 18 in Tripp County, at which time a vehicle driven by Colorado Springs, Colorado, resident Andrea Geist was stopped, according to court documents.
Police observed the male passenger was breathing heavily and appeared nervous, and officers smelled marijuana.
The man admitted to having a marijuana pipe in the center console and ingesting marijuana earlier in the day. Upon searching the vehicle, police found the marijuana pipe in the console, another pipe under the passenger seat and one in the glove box. Another pipe was found in a backpack, along with a small baggy of marijuana. A medical marijuana container with 1.329 ounces of marijuana edibles inside was found in Geist's purse.
Geist said she purchased and brought the marijuana from Colorado to South Dakota and said she uses the edibles for herself, as well as gives them to her young son regularly.
The label on the marijuana edibles clearly stated to keep out of reach of children, according to police. Geist claimed to have acquired the marijuana in Colorado by using a medical marijuana card.
Geist and her male passenger were arrested and the South Dakota Department of Social Services took custody of the children. The children were evaluated by medical personnel at a Winner hospital.
Geist was charged with child abuse, a Class 4 felony, possession of a controlled substance, a Class 5 felony, along with possession with intent to distribute of less than 0.5 ounces of marijuana, possession of 2 ounces of marijuana or less, ingestion of intoxicant other than alcohol and possession of drug paraphernalia, all misdemeanors.
