City Commissioners are nearing a final vote on a change to land development regulations allowing medicinal marijuana outlets in commercial areas.

On Monday night, the City Commission held a public hearing on the marijuana issue and on changes to land development regulations requiring lots to be slightly larger in areas zoned as single-family residential 3, toughening landscaping requirements in commercial areas and ensuring there will not be gaps in sidewalks as new developments build out.

An additional public hearing will be held at the Aug. 21 meeting before final votes are taken. No one from the public spoke on any of the issues.

Medical marijuana

In following state law that allows cities to either ban or permit medical marijuana outlets in the same zoning categories as pharmacies, the City Commission has continued on its path to allow the pharmacies, approving an ordinance on first reading by a 4-0 vote with Commissioner Jim Moody absent.

The Planning and Zoning Commission had split its vote 3-3 on whether to recommend the ordinance, meaning it failed to recommend the ordinance, said Community Development Director Amy Palmer.

In November, Florida voters approved allowing the sale and use of medicinal marijuana. On Jan. 23, the City Commission adopted an 180-day moratorium on permitting the facilities until the state provided guidelines on implementing the law. On June 23, Gov. Rick Scott signed the medical marijuana bill and it went into effect July 1.

In making the motion to approve the ordinance on the first of two readings, Commissioner Richard Hamann commented, "this is what the state allows; we cannot adopt anything stricter than what the state allows."

Pharmacies, and under the proposed ordinance medicinal marijuana outlets, are allowed in areas zoned for commercial and industrial use.
