PA: Upper Gwynedd Board Could Vote Monday To Advertise Medical Marijuana Code

Monday night could bring the next step toward ratifying rules for medical marijuana facilities in Upper Gwynedd.

The township's commissioners could vote to advertise an ordinance that would allow medical marijuana growers and dispensaries, but only in two specific portions of the township.

"We are recommending, through this ordinance, that you allow for the growing and processing in the industrial district, and the dispensing in the commercial district," said Solicitor David Onorato.

"The way we've written our ordinance, those two uses would be under, and subject to, the medical marijuana act of Pennsylvania, which has zoning limitations built into the act as to where those uses could be," he said.

Over the past year, the state legislature has developed a permitting process for medical marijuana facilities, which must receive permits from the state and must be allowed within certain areas by local municipalities. In Upper Gwynedd's case, the industrial district is located along Wissahickon Avenue and would be the only area where growing is allowed, while commercial zoning, where dispensaries would be permitted, covers several parcels along Sumneytown Pike near Valley Forge Road, Broad Street and Church Road, and parts of Broad Street south of Whites Road and at the corner of Valley Forge and Allentown roads.

"The overlay on top of this essentially is the act itself. So even though it'll be allowed in commercial (properties), it still has to meet the requirements of the act," Onorato said.

"As an applicant, under the state regulations, you can get licensed, but you still have to get your zoning. They can license it, but it's still up to the local municipality to allow it by way of zoning," he said.

Last month, Upper Gwynedd staff said they had only received one informal inquiry for a possible medical marijuana facility, but they suggested the township put in place a new ordinance restricting the areas before nay other applications arrive. That ordinance was discussed during the board's workshop meeting Aug. 15, and the commissioners could vote Monday night to publicly advertise the ordnance during their action meeting Monday night, Aug. 28.
