WINDSOR, Ont. -- An Ontario judge says he'll rule Thursday on the question
of whether Canada's laws that make it illegal to possess small amounts of
marijuana are invalid.

Ontario Court Justice Douglas Phillips said he will have a decision in the
case of a 16-year-old youth who was charged in April with possession of
marijuana.

Lawyer Brian McAllister, who is representing the young offender, brought
forward an application to have the drug charges dropped, asserting the
Controlled Drugs and Substances Act no longer prohibits the simple
possession of pot by virtue of an earlier decision in the Ontario Court of
Appeal involving less than 30 grams of marijuana.
