Friendly or unfriendly

Can anyone help me identify this pest. I think it is spider mites. However they don't really go up to the leaf area and the plants seem to be growing fine. I have sprayed several times with Mighty and it does not seem to help. Please advise

Fast moving around the edge of pot flailing front limbs about like an ant= beneficial mite searching for a pest to eat
Slow moving on plant or soil= pest or soil recycler
Not a spider mite, looks sorta like a hypoaspis miles bug. (Good bug)
