The Manhattan Beach City Council passed a ban on all but the private storage and use of medical marijuana at its regularly scheduled meeting Tuesday night.
The temporary ordinances were introduced as "interim" and "urgency" legislation that prohibits cultivating, selling and delivering medical marijuana in the city.
The city banned medical marijuana dispensaries in 2008, however, under the Medical Marijuana Regulation and Safety Ac, which takes effect March 1, 2016, cities must take action if they want to ban or regulate medical marijuana cultivation. Otherwise, the California Department of Food and Agriculture will become the sole licensing authority for medical marijuana cultivation applications, said City Attorney Quinn Barrow.
Council members voted unanimously for all of the ordinances, and no member of the public spoke on the matter, according to the Daily Breeze.
Wrote Barrow in his report to council: "The ordinance is necessary for the immediate preservation of the public peace, health or safety, and if adopted, shall take effect immediately," according to the Easy Reader.
The city attorney told council that the city needs to enact laws specifically mentioning each aspect of medical marijuana - cultivation, dispensaries, and deliveries -- in order to be on solid legal footing.
"People are scrambling and we're ahead of the curve," said Mayor Mark Burton to Barrow. "So thank you very much."
On Wednesday, Dec. 9, the Planning Commission will consider a zoning code amendment that would make medical marijuana cultivation illegal; that ordinance could possibly be considered by council in January.
Council will consider a permanent ban on mobile dispensary deliveries, including delivery of Internet purchases, at its next regularly scheduled council meeting on Tuesday, Dec. 15.
