City Of MLT To Hold Open House May 13 On Draft Medical Marijuana Ordinance

The City of Mountlake Terrace is conducting an open house to provide information and seek public input on a draft medical cannabis ordinance on Monday, May 13, from 6-7 p.m., followed by a Planning Commission public hearing at 7 p.m. in the Interim City Hall Council Chambers located at 6100-219th St. S.W., Suite 220.

The draft ordinance proposes allowing medical cannabis collective gardens, a type of cooperative for up to ten qualifying patients, in the Light Industrial/Office Park zone of Mountlake Terrace. This zone is primarily in the northwest corner of the city, mostly north of 220th Street Southwest and west of I-5. Buffers of at least 500 feet would be required from any parks, schools, the Interurban Trail, and recreational facilities that allow minors.

Other restrictions on collective gardens listed in the proposed ordinance are that they would have to be entirely within a building, the building space would have to be inspected for building and fire code issues, and the collective garden could only operate if it had first obtained a certificate of safe occupancy from the city.

Zoning-related issues and options for medical cannabis were discussed at the City Council's April 11 work/study session. Given uncertainty about legal issues, particularly the conflict between state and federal law, Mountlake Terrace had adopted a moratorium on collective gardens and other cannabis activities. Under state law, moratoria are only allowed to be temporary, with the city's current moratorium expiring June 15, 2013.
