Tampa's Strip Club King Joe Redner Wants To Transform Florida's Medical Marijuana Law

Strip club mogul, free speech activist and Tampa icon Joe Redner is suing the Florida Department of Health over its rules regarding medical marijuana cultivation.

The lawsuit, if successful, could spell huge change in Florida's medical marijuana debate. Under implementing guidelines for Amendment 2, the state blocks qualified medical marijuana patients from growing the plant.

Supporters expect several lawsuits, including one from Orlando attorney and Amendment 2 financier John Morgan, challenging the state's rules blocking patients from smoking marijuana.

Redner's lawsuit represents another concern Amendment 2 supporters have with Florida law: A ruling in Redner's favor would open the door for other patients to begin growing their own plants.

Redner's legal argument hinges on a sole provision of Florida law that defines medical use of marijuana as the acquisition, possession, use, delivery, transfer or administration of marijuana. His attorney, Amanda Derby, argues the law does not specifically block qualified patients from growing cannabis plants for personal use.

Redner suffers from stage 4 lung cancer and has received a qualified patient card under the state's medical marijuana compassionate use registry. He makes his own oil and butter to administer the drug as well as juicing the actual plant.

The suit describes Redner as immunocompromised and explains that he should be able to maintain "control over all the substances put into his body."

But under current state law, Redner could face felony charges if he chooses to grow his own marijuana rather than obtaining it through a legal dispensary.

Redner's attorney did not respond to a request for comment from her or her client.
