Another Lawsuit Over Illinois Medical Marijuana Licensing Process

A company called PM Rx LLC has sued the state of Illinois, seeking to stop the Illinois Department of Agriculture from issuing a marijuana cultivation license to a competitor until its concerns about the process that led to the initial granting of that license are addressed.

The key claim of PM Rx's suit is that it scored higher on evaluations than Cresco Labs LLC, but that Cresco won a license and PM Rx did not after Cresco met with then-Governor Pat Quinn, the Chicago Sun-Times reported. A spokesperson for Quinn denied that charge, saying that Quinn did not meet with applicants to talk about their applications, the report said.

Furthermore, PM Rx's suit argued, the state improperly moved forward with Cresco's application even though certain background checks were not completed and Cresco had not secured the required amount of funding, the Sun-Times reported.

For its part, Cresco told the Chicago Tribune that it did have the required funding in place before submitting its application, and that it has been seeking even more investment since being awarded its cultivation licenses simply as a means of spreading investment risk.

Both reports noted that this is believed to be the second lawsuit filed over the state's marijuana-licensing process. The first was filed by a company that argued a not-for-profit entity was improperly awarded a license because marijuana cultivation is still illegal under federal law and that entity receives certain tax benefits from the federal Internal Revenue Service.
