CA: Vacaville Moves Forward With Marijuana Regulations

City Council members grudgingly told staff Tuesday night to come back with an ordinance regulating how medical and recreational marijuana will be sold in town.

If they didn't, the state would be calling the shots on where marijuana would be cultivated and sold in Vacaville as of Jan. 1, 2018, something the council could not stomach.

The legislation created a framework for how to cultivate, transport and sell marijuana beyond what Vacaville's municipal codes presently address.

Council members voted in January 2016 to prohibit all medical marijuana business and cultivation of medical marijuana in town.

"I have been a strong voice against it, but the state has spoken and we need to regulate," City Councilman Ron Rowlett said of Proposition 64, passed in November, which allows the recreational use of marijuana in California.

After hearing a small number of speakers for and against marijuana, the council started tossing out ideas for what they want to see in marijuana-related land-use ordinances and regulations.

Rowlett called for a limit of two dispensaries, one on each side of Interstate 80 out in industrial areas away from homes and schools.

Priority for permits for such dispensaries should go to local residents, Rowlett said. He also spoke against allowing commercial cultivation in town.

Councilman Mitch Mashburn didn't want to see any dispensaries, but would allow deliveries to be made to customers.

Mashburn also wondered if it was possible to require homes growing marijuana for personal use to have permits so that they could be inspected for safety.

"I would like to see a production facility in the industrial areas," Mashburn said, citing the revenue it could provide the city.

Councilman Curtis Hunt wanted to see the question of what constituted reasonable taxes on selling or cultivating marijuana. He also wanted to see dispensaries closely regulated when it came to hours, security and advertising.

"We are stuck with having to compromise," Mayor Len Augustine said, making it known he didn't want marijuana in Vacaville but agreed with what his fellow council members said.

The council told staff to come forward with a new moratorium on marijuana sales or cultivation in town as quickly as possible to give city staff time to research and come up with marijuana regulations later this fall.
