California: Indian Wells Toughens Medical Marijuana Ordinances

The Indian Wells City Council on Thursday approved an ordinance banning the delivery and production of medical marijuana within the city.

The city already has an ordinance prohibiting dispensaries.

No one from the public spoke for or against the ordinance during the public hearing and the council approved the ordinance without discussion.

The ordinance is similar to those adopted by La Quinta and Palm Desert councils in December in response to a new California law, the Medical Marijuana Regulation and Safety Act of 2015 — or MMRSA — which took effect Jan. 1 and requires marijuana cultivators and delivery services be licensed by the state as well as local jurisdictions that have ordinances in place.

To avoid the state having sole control, cities and counties have until March 1 to adopt their own ordinances, getting tough laws on the books now knowing they can revisit and loosen them later.

The ordinances in Palm Desert and La Quinta ban delivery, but each council has promised to revisit and possibly relax the rules on delivery for patients with prescriptions for medical marijuana.

The Indian Wells ordinance requires a second reading and vote, which is expected at its Jan. 27 special meeting and strategy session, starting at 9 a.m. at the Indian Wells Golf Resort.
